Terms of Service

1. About the Service

Moments is a tool that turns a video into a navigable workspace. When you upload a video or provide its URL, the Service runs a processing pipeline that extracts a transcript and a set of keyframes so you can move through the video by what was said and what was shown.

The transcripts, keyframes, and other automatically generated outputs are produced by algorithms and may contain errors or inaccuracies. You are responsible for evaluating any such output and assume all risk of relying on it. Subject to your compliance with these Terms, Moments grants you a limited, non-transferable, non-exclusive, revocable right to access and use the Service.

2. Eligibility and Accounts

To use the Service you must have the legal capacity to enter into these Terms. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or guardian.

Certain features require a registered account. You agree to provide true, accurate, and complete registration information and to keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. If you discover any unauthorised use, notify us at once at hello@moments.app.

When using the Service you agree not to:

• Upload content that infringes the intellectual property, privacy, publicity, or other rights of any third party;
• Upload content that is unlawful, defamatory, obscene, abusive, or otherwise objectionable;
• Attempt to reverse-engineer, decompile, scrape, or otherwise interfere with the Service or its underlying infrastructure;
• Use the Service to develop a competing product or to train machine-learning models without our prior written consent;
• Probe, scan, or test the vulnerability of the Service, or attempt to bypass any rate limit, quota, or security control;
• Use the Service to send unsolicited commercial communications or otherwise abuse our infrastructure.

We may suspend or terminate access for any violation of these rules.

5. Pricing and Beta

The Service is currently in beta and provided free of charge. We may introduce paid tiers in the future; if and when we do, we will provide notice before any fee applies to you. We may also impose reasonable usage limits (storage, processing minutes, request rates) to keep the Service stable, and may adjust those limits with notice.

6. Service Availability and Changes

We work to keep the Service reliable but do not guarantee uninterrupted availability. We may add, modify, or remove features at any time, and may suspend the Service for maintenance, security, or legal reasons. We will give reasonable notice of material changes when feasible.

7. Termination

You may stop using the Service at any time and may delete individual videos or your account from the workspace. We may suspend or terminate your access if you breach these Terms, use the Service in a way that creates risk for us or other users, or if we are required to do so by law. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitations of liability, and dispute resolution — will survive.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Transcripts, keyframes, and other outputs are generated automatically and may be incomplete or inaccurate; you should not rely on them as authoritative.

9. Limitation of Liability

To the maximum extent permitted by law, Moments will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or related to the Service is limited to the greater of the fees you have paid us in the twelve months before the claim arose and one hundred US dollars.

10. Indemnification

You agree to defend, indemnify, and hold harmless Moments and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, Your Content, or your violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Moments is established, without regard to its conflict- of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the courts of that jurisdiction, except where mandatory consumer-protection law gives you the right to bring proceedings elsewhere.

We may modify these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page; for material changes we will provide additional notice. Continued use of the Service after changes are published constitutes acceptance of the updated Terms.
